Both divorce and legal separation require a similar legal procedure and have similar outcomes. In a legal separation, both parties agree to put parenting plans and support orders in place. All assets and debts acquired by the couple during the marriage up to the point of separation are divided. All assets and debts acquired after the legal separation, however, are the full responsibility of the spouse acquiring them. The spouses remain married by law. In Colorado, either spouse can petition the court to convert the legal separation into an actual divorce; this must not occur within 6 months of the date the legal separation was entered by the court.
